Terms of Service

1. Acceptance of terms

By creating an account or using Breatic you accept these terms. If you use Breatic for an organisation, you confirm you may bind that organisation. You must be old enough to enter a contract where you live; if you are under 18, you need a parent or guardian to accept on your behalf. We may update these terms — material changes are announced in the product and by email before they take effect, and continuing to use Breatic after that date means you accept the new version.

2. Accounts & eligibility

One account, one person. You are responsible for everything done under your account and for keeping your password safe; tell us at security@breatic.ai if you think someone else has access. We may suspend an account that is being used to break these terms, and we will tell you why. You can delete your account at any time — see section 8 for what happens to your work when you do.

3. Your content & ownership

What you make in Breatic is yours. We claim no ownership of your projects, uploads, or generated output. You grant us only the licence we need to run the service: to store, process, transmit and display your content so the product works, to send it to the model provider you chose when you ask for a generation, and to pass it through the additional model steps described in the Privacy Policy. That licence ends when you delete the content. You are responsible for what you upload — you must have the rights to it, and it must not break the law or section 4.

4. Acceptable use

Do not use Breatic to produce or distribute illegal material, to infringe someone else's rights, or to harass or endanger people. Do not resell access to your account, share one account across a team in place of paying for one, or use the service to build a competing generation API. Credits are for use inside Breatic: they cannot be gifted, transferred, traded, or cashed out. Automated abuse — scripted signups, circumventing quotas, scraping — will end in suspension. We publish what we look for rather than enforcing silently, and an account we act against gets told, with a way to appeal.

5. Credits & payment

Breatic bills on two independent legs. A plan covers storage and collaboration scale; credits cover generation. A plan carries no generation allowance, and the two are bought separately. Current tiers, prices and pack sizes are on the pricing page. Credits do not expire, and a generation that fails returns the credits it took. All prices exclude tax — your total at checkout is the listed price plus the tax where you are. Refunds on credits: bought within the last 30 days and not a single credit spent, we refund the pack in full to the original card. Spend any of them, even one, and that pack is no longer refundable. Past 30 days, no refund. It is the whole pack or nothing — there is no partial refund, and a pack can be refunded once. The 30 days run from the moment payment succeeds, counted in UTC calendar days. Every refund is reviewed by a person. Plan fees are not refundable — not pro-rated, not by remaining days. You can cancel a subscription yourself at any time, by the same route you subscribed; service continues to the end of the billing period, then the account drops to the free tier. Auto top-up of credits is off unless you switch it on, and switching it on is separate from agreeing to subscription renewal.

6. Intellectual property

The Breatic name, logo, and site design are ours. The source code is available under the Breatic Source-Available License (BSAL) — you can read it, run it, and self-host it under that licence's terms, which is not the same as open source: the licence restricts offering Breatic as a competing public service. Clause 1(c) of the licence grants you commercial rights over what you create with Breatic, and clause 2 says the Breatic logo, trademark, and copyright notice must not be removed or altered anywhere in the software. Self-hosted installations are not subject to any plan ceiling.

7. Disclaimers & liability

Breatic is provided as is. We do not warrant that generation output is accurate, original, or fit for any particular purpose — generative models can produce wrong or duplicated results, and checking output before you rely on it is your call. We do not guarantee uninterrupted service. To the extent the law allows, our total liability for any claim is capped at what you paid us in the twelve months before it arose, and we are not liable for indirect or consequential loss, including lost profit or lost data beyond our retention duties in section 8. Nothing here limits liability that cannot be limited by law.

8. Changes, termination & contact

Your data is kept, not deleted. Downgrading lowers your storage limit. While you are over the limit you cannot upload anything new and you cannot generate anything new; nothing already stored is deleted or locked, and export stays free on every tier including the free one. An account with no login for 24 consecutive months is frozen rather than erased — the features stop, the data does not, and export keeps working. Reactivating a frozen account carries a charge, and we will tell you what it is before you commit to it. If you delete your account yourself, we delete your content on the schedule in the Privacy Policy. We may end service for a serious or repeated breach of section 4, with notice and an export window except where the law requires immediate action. Questions about these terms: contact@breatic.ai.
